These Terms and Conditions ("Terms") govern all bookings made with KMA Travel & Tours Sdn Bhd ("we", "us", "our"), a travel agency registered in Malaysia (Company No. 201801004103 (1266117-W), MOTAC Licence No. [MOTAC LICENCE NO]). By making a booking, paying a deposit, or using shop.kmatraveltours.com, you confirm that you have read, understood and accepted these Terms on behalf of yourself and everyone in your booking party.
1. Definitions
- "Booking" means a confirmed reservation for any travel product or service supplied or arranged by us.
- "Lead Passenger" means the person who makes the booking and accepts these Terms for all members of the party.
- "Supplier" means any airline, hotel, transport operator, cruise line, ground handler, insurer or other third party providing part of your arrangements.
- "Travel Documents" means tickets, vouchers, itineraries and confirmations issued to you.
2. Our Role
For packages we assemble and sell under our own name, we act as principal. For individual components such as flight-only, hotel-only or attraction tickets, we act as an agent for the Supplier, and your contract for those services is with that Supplier and subject to its own terms and conditions of carriage or accommodation. We will make those terms available on request.
3. Booking and Contract
- A booking request is an offer to purchase. No contract exists until we issue a written booking confirmation and have received the required deposit or full payment in cleared funds.
- The Lead Passenger must be at least 18 years old and is responsible for all payments and for passing our communications to the rest of the party.
- You must check your booking confirmation and Travel Documents immediately on receipt. Notify us of any error within 3 working days. Corrections requested later may incur Supplier amendment fees.
- Names on your booking must exactly match the passport or identity document you will travel on. Airlines generally treat a name change as a cancellation and rebooking, at your cost.
4. Prices and Payment
- All prices are quoted in Malaysian Ringgit (RM) unless stated otherwise, and are per person based on the occupancy shown.
- Quoted prices are not guaranteed until your booking is confirmed and the deposit received. Prices are subject to availability and may change without notice before confirmation.
- Unless stated otherwise, a non-refundable deposit of [DEPOSIT AMOUNT / PERCENTAGE] is payable on booking, with the balance due [BALANCE DUE DAYS] days before departure.
- Bookings made within [BALANCE DUE DAYS] days of departure require full payment at the time of booking.
- If the balance is not received by the due date, we may treat the booking as cancelled by you and apply the charges in our Return, Refund & Cancellation Policy.
- After confirmation we will only increase the price to reflect changes in transport costs, fuel, taxes, landing or embarkation fees, or exchange rate movements. We will absorb any increase up to 2% of the tour price. Where the increase exceeds 10% of the tour price you may cancel and receive a full refund of monies paid to us.
5. What Is and Is Not Included
Your itinerary sets out exactly what is included. Unless expressly stated, prices exclude: visa and consular fees, travel insurance, airport transfers, excess baggage, meals not listed, drinks, tips and porterage, optional excursions, personal expenses, and any cost arising from a delay, cancellation or rerouting outside our control.
6. Passports, Visas, Health and Entry Requirements
- It is your sole responsibility to hold a valid passport (generally with at least six months' validity beyond your return date and sufficient blank pages), together with all visas, permits, vaccination certificates and health documentation required by every country on your itinerary, including transit points.
- Entry requirements change frequently and differ by nationality. Any information we provide is given in good faith as a courtesy and must be verified with the relevant embassy, consulate or official government source.
- We accept no liability whatsoever if you are refused boarding, transit, or entry, or are deported, for want of correct documentation. No refund will be due in those circumstances.
- You must advise us at the time of booking of any medical condition, disability, reduced mobility, dietary requirement or pregnancy that may affect your arrangements, so that we can advise on suitability.
7. Travel Insurance
Comprehensive travel insurance is strongly recommended for every traveller and may be a condition of certain tours. Your policy should cover at minimum medical expenses and repatriation, personal accident, cancellation and curtailment, baggage, and any activity you intend to undertake. We are not liable for any loss you incur that adequate insurance would have covered.
8. Changes and Cancellations by You
All amendment and cancellation requests must be made in writing by the Lead Passenger. Charges are set out in our Return, Refund & Cancellation Policy, which forms part of these Terms.
9. Changes and Cancellations by Us
- Our arrangements are planned far in advance and occasionally must change. Most changes are minor and we will notify you as soon as reasonably possible.
- A significant change means a change of departure or return date, a change of departure airport other than between airports serving the same city, a downgrade of accommodation for the majority of the trip, or a change that materially alters the character of the tour.
- Where a significant change occurs before departure you may: (a) accept the change; (b) transfer to a comparable alternative, paying or receiving the difference; or (c) cancel and receive a full refund of monies paid to us.
- We may cancel a tour that does not reach the stated minimum number of participants. We will notify you no later than [MINIMUM NUMBERS NOTICE] days before departure and offer you the options in clause 9.3.
- Except where cancellation results from your default or from an event described in clause 11, our liability for a cancellation by us is limited to a refund of monies paid to us.
10. Your Conduct
You must comply with the laws, customs and regulations of every country visited, and with the reasonable instructions of tour leaders and Suppliers. We and our Suppliers may refuse to carry or accommodate any person whose behaviour is, in our reasonable opinion, likely to cause danger, distress, damage or serious disruption. Where this happens, our responsibility for your arrangements ends immediately, no refund is due, and we will not meet any cost of onward or return travel. You are responsible for any damage or loss you cause and must indemnify us against any claim made against us as a result.
11. Force Majeure
We are not liable for any failure or delay in performing our obligations caused by circumstances beyond our reasonable control, including war or threat of war, civil unrest, terrorism, riot, industrial dispute, natural or nuclear disaster, fire, flood, adverse weather, volcanic ash, epidemic or pandemic, government action, border or airspace closure, quarantine, and airport, port or airline closure or schedule change. In such circumstances we will refund the recoverable portion of monies paid, after deducting sums already paid to Suppliers that are not recoverable by us.
12. Our Liability
- We accept responsibility for exercising reasonable skill and care in making the arrangements we have agreed to provide.
- We are not liable for any injury, illness, death, loss, damage, expense, cost or claim that results from your own act or omission, from the act or omission of a third party unconnected with the provision of your arrangements and unforeseeable or unavoidable, or from an event described in clause 11.
- Where we act as agent (clause 2), our liability is limited to the proper performance of our agency obligations, and any claim relating to the service itself lies against the Supplier.
- Where any international convention applies, including the Montreal Convention for air travel, our liability is limited as that convention provides.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded, including your statutory rights under the Consumer Protection Act 1999.
13. Complaints
If a problem arises during your trip, you must raise it immediately with the tour leader, hotel or Supplier so that it can be put right at the time. If it cannot be resolved locally, write to us at enquiry@kmatraveltours.com within 30 days of returning, quoting your booking reference. Failure to follow this procedure may affect our ability to investigate and reduce any compensation due.
14. Photography and Marketing
We may photograph or film group tours for promotional purposes. If you do not wish to appear in such material, please notify the tour leader at the start of the tour or write to us at enquiry@kmatraveltours.com.
15. Personal Data
We process your personal data in accordance with the Personal Data Protection Act 2010 and our Privacy Policy, which forms part of these Terms.
16. Website Use
Content on shop.kmatraveltours.com is provided for general information. While we take care to keep it accurate, itineraries, prices and availability may change, and we do not warrant that the site will be uninterrupted or error-free. All text, images and design on this site are our property or licensed to us and may not be reproduced without written permission.
17. Governing Law
These Terms are governed by the laws of Malaysia, and you and we submit to the exclusive jurisdiction of the Malaysian courts.
18. Severability and Amendment
If any provision of these Terms is found unenforceable, the remaining provisions continue in force. We may amend these Terms at any time; the version in effect on the date of your booking applies to that booking.
